SUBJECT: Possess Prohibited Drug – Character References – No Prior Convictions – Good Behaviour Bond – Plea of Guilty.

FACTS: The client was at Randwick Racecourse. He was obviously intoxicated. The police asked him to leave the racecourse. Instead of leaving he entered the bathroom and remained there for 10 minutes. The police thought this to be suspicious and entered the bathroom. They located the accused with a small resealable bag with white powder. Police took the bag and arrested the accused. This was later identified as a small amount of cocaine. He was charged with possess prohibited drug. The total weight of the drugs were 0.5g.

 

RESULT The client pleaded guilty to the charge. Submissions were made about his extraordinary subjective features and accordingly no conviction was recorded, instead he was sentenced to a nine month good behaviour bond pursuant to Section 10 (1)(b) of the Crimes (Sentencing Procedure) Act 1999.

The maximum penalty for this offence being 2 years imprisonment, or 20 penalty units or both.
